These Terms & Conditions ("Terms") govern your access to and use of the 𝐎𝐦𝐚𝐫 𝐀𝐜𝐚𝐝𝐞𝐦𝐲 mobile application and related services (together, the "Service"), operated by 𝐎𝐦𝐚𝐫 𝐀𝐜𝐚𝐝𝐞𝐦𝐲 ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

01 Eligibility

The Service is intended for university-level students and for tutors approved by us. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using it, you represent that the information you provide is accurate and that you are legally able to enter into these Terms.

02 Your account

You need an account to use most features. Students may register directly; tutors are added by invitation from our team. You are responsible for keeping your login details secure and for all activity that happens under your account. Tell us right away if you believe your account has been used without your permission.

• Keep your account information current and truthful.
• Do not share your account or let anyone else use it.
• We may suspend accounts that appear to be shared, automated, or fraudulent.

03 What the Service does

𝐎𝐦𝐚𝐫 𝐀𝐜𝐚𝐝𝐞𝐦𝐲 connects students with tutors for their university courses. Depending on your role, the Service lets you enroll in courses, be matched with a tutor, request and manage assignments, track deadlines and progress, exchange messages through a reviewed inbox, and access shared study resources. Features may change, be added, or be removed over time.

04 Tutor anonymity & moderated messaging

To protect everyone and keep the platform fair, tutors are shown to students only by an anonymized code, never by their personal contact details, and the same applies in reverse where relevant.

05 Assignments & academic integrity

𝐎𝐦𝐚𝐫 𝐀𝐜𝐚𝐝𝐞𝐦𝐲 is a learning and tutoring tool. Tutoring, worked examples, drafts, and study materials are provided to help you understand your coursework and improve your own work. You are responsible for using the Service in line with your institution's academic-integrity rules.

• Use the guidance you receive to learn, and submit work that is genuinely your own where your institution requires it.
• Do not use the Service to cheat, plagiarize, sit assessments on your behalf, or otherwise violate any exam or coursework policy.
• You are solely responsible for how you use any material obtained through the Service, and for the academic consequences of that use.

06 Payments & tutor payouts

Where a feature involves a fee, the amount and terms are shown before you commit. Tutors may earn amounts for completed work, tracked in the app and paid out according to our then-current payout process. Taxes, mobile-money charges, or bank fees may apply. Unless stated otherwise or required by law, amounts already earned or paid are non-refundable once work is delivered.

07 Acceptable use

You agree not to:

• Break the law or infringe anyone's rights while using the Service.
• Harass, threaten, or abuse other users, or post hateful, obscene, or misleading content.
• Upload malware, attempt to breach security, scrape data, or disrupt the Service.
• Reverse-engineer, copy, or resell the Service except as allowed by law.
• Circumvent tutor anonymity or the message-review process described in Section 4.

08 Content & intellectual property

You keep ownership of the content you submit (such as assignment briefs, messages, and files). You grant us a limited licence to host, process, and display that content solely to operate the Service. Everything else, including the 𝐎𝐦𝐚𝐫 𝐀𝐜𝐚𝐝𝐞𝐦𝐲 name, logo, design, and software, belongs to us or our licensors and may not be used without our permission. You are responsible for ensuring you have the rights to any content you upload.

09 Termination

You may stop using the Service and delete your account at any time from the account deletion page. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or if we discontinue the Service. Some provisions, by their nature, survive termination — including intellectual property, disclaimers, and limitation of liability.

10 Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any tutoring or materials will meet a particular academic outcome. 𝐎𝐦𝐚𝐫 𝐀𝐜𝐚𝐝𝐞𝐦𝐲 does not guarantee grades and is not a substitute for your own study and compliance with your institution's rules.

11 Limitation of liability

To the maximum extent permitted by law, 𝐎𝐦𝐚𝐫 𝐀𝐜𝐚𝐝𝐞𝐦𝐲 and its team will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, data, or academic standing, arising from your use of the Service. Where liability cannot be excluded, it is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim.

12 Indemnification

You agree to indemnify and hold harmless 𝐎𝐦𝐚𝐫 𝐀𝐜𝐚𝐝𝐞𝐦𝐲 and its team from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms or of any law or third-party right.

13 Governing law

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts of Kenya for any dispute that cannot be resolved informally, except where applicable law grants you rights in your own country of residence.

14 Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page. Continuing to use the Service after changes take effect means you accept the revised Terms.
